This policy distinguishes between purchases made by individual consumers (B2C) and purchases made for business or professional purposes (B2B).
2. Consumer Right of Withdrawal (B2C)
Consumers have a statutory right to withdraw from eligible distance purchases within 14 calendar days of receiving the goods, without giving any reason.
To exercise this right, customers must notify INSO STAR EUROPE of their decision before the withdrawal period expires.
Notifications may be sent to:
Customers may also use the online withdrawal facility made available on the website.
The use of a specific withdrawal form is not mandatory, provided that the customer clearly communicates their decision.
3. Return Address
Unless the company provides alternative return instructions, goods must be returned to:
INSO STAR EUROPE
ENDELAY ASSETS, S.L.
Carrer Principal P.I.Codonye, 8
46220 Picassent, Valencia, Spain
Customers should contact the company before arranging transport to receive appropriate instructions for handling and delivering the vehicle.
This recommendation does not restrict the statutory right of withdrawal.
4. Return Transport and Costs
Where a consumer exercises the statutory right of withdrawal, the consumer will bear the direct cost of returning the goods, provided that this responsibility has been properly communicated before purchase and subject to applicable law.
Due to their dimensions and characteristics, certain mini cars may require specialist transport.
The applicable return transport costs, or the required estimate for goods that cannot normally be returned by post, must be communicated before the purchase is completed.
Customers may arrange suitable return transport, subject to any necessary safety, handling and delivery requirements.
Where INSO STAR EUROPE is legally responsible for return costs, including qualifying cases involving defective or non-conforming products, the applicable expenses will be borne by the company.
5. Returning a Product
Following notification of withdrawal, consumers must generally return the goods within 14 calendar days, unless the company offers to collect them.
Customers are advised to:
- Protect the vehicle adequately for transportation.
- Include the accessories and components supplied with the product.
- Keep the purchase reference and available transport documentation.
- Photograph the vehicle before collection where useful.
- Retain evidence of dispatch or collection.
Original packaging is recommended where available but is not an absolute condition for exercising statutory consumer rights.
Consumers may be responsible for any reduction in the value of the goods caused by handling beyond what is necessary to establish their nature, characteristics and functioning.
6. Refunds
Where withdrawal is validly exercised, refunds will be processed in accordance with applicable consumer legislation.
The company will reimburse the legally refundable payments, including the standard outbound delivery charges where applicable.
Additional charges arising from the customer’s choice of a more expensive delivery service than the least expensive standard option offered are not necessarily refundable.
The refund will be made without undue delay and, generally, within 14 calendar days of receiving the withdrawal notification.
For sales of goods, the company may withhold reimbursement until receiving the goods or evidence that they have been returned, whichever occurs first, unless it has offered to collect them.
Refunds will normally be made using the same payment method used for the original transaction, unless another method is expressly agreed without additional cost to the consumer.
7. Damaged, Defective or Incorrect Products
If a product arrives damaged, is not in conformity with the contract or differs from the product ordered, the customer should contact:
To facilitate the assessment, the company may request:
- Order number or other proof of purchase.
- Description of the problem.
- Photographs or videos showing the reported issue, where reasonably available.
- Product identification details.
- Information about the delivery and condition of the packaging.
The absence of optional photographs, original packaging or an original invoice does not automatically remove statutory consumer rights.
Where a lack of conformity is covered by the statutory guarantee, the consumer will be entitled to the applicable legal remedies.
Repair or replacement, where legally required, will be provided free of charge, including necessary transport and related costs.
The company will arrange or coordinate the appropriate procedure according to the circumstances.
8. Legal Guarantee
For new goods sold to consumers under Spanish law, the statutory conformity guarantee generally covers defects or lack of conformity existing at delivery and becoming apparent within three years.
Depending on the circumstances and statutory requirements, remedies may include repair, replacement, a price reduction or termination of the contract.
The applicable statutory rights remain unaffected by this policy.
9. Customised or Made-to-Order Products
Certain products manufactured to the consumer’s individual specifications or clearly personalised may be excluded from the statutory right of withdrawal where the requirements of applicable law are met.
Any such exception must be clearly identified before purchase.
The fact that a product is manufactured after an order is placed does not, by itself, necessarily exclude the right of withdrawal.
Exclusions from withdrawal do not eliminate mandatory rights relating to defective or non-conforming products.
10. Professional Purchases (B2B)
Purchases made exclusively for business or professional purposes are not automatically covered by the statutory consumer withdrawal regime.
Returns of professional orders will be subject to applicable law and the commercial conditions expressly agreed for the transaction.
Where a voluntary commercial return is accepted, the applicable transport arrangements and costs will be confirmed in writing.
Nothing in this policy excludes mandatory rights or liabilities applicable to professional contracts.
11. Vehicle Use and Homologation
The mini cars marketed by INSO STAR EUROPE are not homologated for use on public roads.
They are intended exclusively for use within private premises or private circuits, subject to the applicable safety rules and local regulations.
Customers must review the technical information and permitted uses of each model before purchase.
This limitation does not affect mandatory rights relating to product conformity or defects.
