2. Scope of Application

These Terms and Conditions apply to purchases made through the INSO STAR EUROPE online store.

The website serves two types of customers:

  • B2C (Business to Consumer): individual customers purchasing products for purposes outside their trade, business or professional activity.
  • B2B (Business to Business): companies, distributors and professionals purchasing products for their commercial or professional activities.

Both customer groups may access the same product catalogue, subject to the access and pricing conditions applicable to each account.

3. Products and Product Information

INSO STAR EUROPE offers mini cars, leisure vehicles and related products through its online catalogue.

Each product page will provide the available information about its characteristics, specifications, included components, price and purchasing options.

Product images are intended to represent the products offered. Any relevant differences, variations or optional equipment will be identified in the corresponding product information.

Customers should carefully review the product description before placing an order.

The suitability of any vehicle for public-road use, private circuits or other locations depends on its specific technical characteristics and the applicable regulations.

Any requirements concerning homologation, registration, driving licences, insurance, age restrictions or permitted use must be assessed according to the particular model and destination.

Products will be supplied with the mandatory information and documentation required by applicable legislation.

4. Prices and Taxes

4.1. Individual Customers (B2C)

Consumers will see the applicable retail prices.

Product prices will include applicable taxes where required by consumer legislation.

Delivery charges and any other additional costs will be clearly communicated before the customer confirms the purchase.

The total amount payable will be displayed before the order is submitted.

4.2. Professional Customers (B2B)

Verified and approved professional customers may access specific B2B prices and commercial conditions.

Professional prices may differ from retail prices.

The applicable tax treatment, delivery charges and final order amount will be indicated during the purchasing process.

Access to professional prices does not automatically grant credit facilities, exclusive distribution rights or other commercial benefits unless expressly agreed.

4.3. International Orders

International purchases may be subject to taxes, customs duties, import charges or other destination-specific requirements.

Any charges collected by INSO STAR EUROPE will be disclosed before checkout. Information about additional charges not collected by the company will be provided where required by applicable law.

If a product cannot be supplied or an order cannot be fulfilled, the customer will be informed and the applicable legal remedies, including reimbursement where appropriate, will be respected.

6. Payment Methods

The payment methods accepted by INSO STAR EUROPE will be displayed during checkout.

Payment availability may depend on the customer’s location, order characteristics and applicable commercial conditions.

Customers must provide accurate information and use payment methods they are authorised to operate.

Payment transactions will be processed through the payment services enabled on the website.

7. Shipping and Delivery

INSO STAR EUROPE offers sales and distribution in Spain and Europe, with international shipping available to eligible destinations.

The delivery options, availability, shipping charges and estimated delivery time will be communicated before the purchase is completed.

Certain products may require special transport arrangements due to their dimensions, weight or characteristics.

For consumer sales governed by Spanish law, unless a different delivery period has been expressly agreed, goods must be delivered without undue delay and within the statutory maximum period of 30 calendar days.

If a delivery cannot be completed within the agreed period, the customer’s rights under applicable law will be respected.

Additional information will be provided in the Shipping & Delivery Policy.

8. Consumer Right of Withdrawal (B2C)

Consumers purchasing eligible goods online generally have the right to withdraw from the contract within 14 calendar days of receiving the goods, without having to provide a reason.

The right may be exercised by sending an unequivocal statement to:

info@insostareurope.com

Consumers may also use the online withdrawal facility provided by the website during the applicable withdrawal period.

Where the statutory right of withdrawal applies:

  • The consumer must notify the company within the applicable period.
  • Goods must generally be returned within 14 calendar days after communicating the withdrawal, unless the company offers to collect them.
  • Refunds will be processed within the applicable statutory period, generally 14 calendar days from notification of withdrawal.
  • For sales of goods, reimbursement may be withheld until the goods have been received or evidence of their return has been provided, unless the company has offered to collect them.
  • Refunds will include the legally refundable amounts, using the original payment method unless otherwise expressly agreed.
  • The consumer may be responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

The direct costs of returning goods will be allocated in accordance with the information provided before purchase and applicable consumer legislation.

For goods that cannot normally be returned by post, the estimated return costs must be disclosed before purchase where legally required.

Certain products, including goods made to the consumer’s specifications or clearly personalised, may be excluded from the statutory withdrawal right where the legal conditions for the exception are met.

The relevant exceptions will be communicated before purchase.

Full information will be provided in the Returns & Refunds Policy.

9. Legal Guarantees (B2C)

Consumer purchases are protected by the mandatory legal guarantee of conformity applicable to the transaction.

For new goods sold to consumers under Spanish law, the seller is generally responsible for lack of conformity that exists at delivery and becomes apparent within three years.

Where applicable, consumers may request the legally available remedies, including repair, replacement, price reduction or termination of the contract.

The applicable remedies will be provided without improperly limiting mandatory consumer rights.

Any additional commercial warranty will be identified separately and will not replace the statutory guarantee.

10. Professional Purchases (B2B)

The professional area is intended for businesses, distributors and customers purchasing in connection with their commercial activities.

10.1. Registration and Approval

Professional access may require:

  • Registration of a business account.
  • Submission of identification and company details.
  • Provision of supporting business documentation.
  • Review and approval by INSO STAR EUROPE.

Professional prices will only become available once the account has been authorised.

10.2. Professional Prices

Approved professional users will see the prices assigned to their account or customer category.

The applicable B2B prices will be used when orders are placed through an authorised professional account.

10.3. Professional Orders

B2B orders will be processed through the same online store and order-management system as consumer orders.

Any specific minimum quantities, payment terms, shipping arrangements or other professional conditions must be expressly communicated and agreed before the relevant purchase.

10.4. Returns and Commercial Guarantees

The statutory consumer withdrawal regime does not automatically apply to purchases made exclusively for business or professional purposes.

Returns, commercial warranties and remedies for B2B transactions will be governed by the applicable legislation and the conditions expressly agreed for each transaction.

Nothing in these Terms excludes rights or liabilities that cannot legally be excluded.

11. Product Availability

Product availability may change.

If an item becomes unavailable after an order has been submitted, INSO STAR EUROPE will contact the customer to explain the situation and the available options.

Any proposed change to the ordered products will require the customer’s agreement where legally necessary.

Consumers will retain their applicable statutory rights.

12. Complaints and Customer Service

Customers may submit questions, complaints or requests relating to their purchases through:

Email: info@insostareurope.com

Telephone: +34 621 14 33 49

INSO STAR EUROPE will handle complaints in accordance with applicable consumer and commercial legislation.

Consumers may also contact the competent consumer protection authorities or alternative dispute resolution bodies where applicable.

13. Personal Data Protection

Personal data collected during registration, purchasing and customer support will be processed in accordance with applicable data protection legislation.

Further information is available in the Privacy Policy.

14. Applicable Law and Jurisdiction

These Terms and Conditions are governed by Spanish law, without prejudice to mandatory consumer protection rules applicable in other jurisdictions.

For consumer purchases, disputes will be submitted to the courts having jurisdiction under the applicable mandatory rules.

For B2B transactions, jurisdiction will be determined by the applicable legislation and any validly agreed contractual arrangements.

15. Changes to These Terms

INSO STAR EUROPE may update these Terms and Conditions when necessary.

Changes will not retroactively alter the conditions of orders already concluded, except where required or permitted by applicable law.

The conditions applicable to a purchase will be those validly communicated and accepted when the relevant contract was concluded.
